Capitalized terms used in these Terms have the meanings set forth herein or elsewhere in these Terms. “Including” means including without limitation.
Services means all SensorTree tools, utilities, platforms, software, mobile and web applications, APIs, firmware, IoT devices, gateways, dashboards, analytics engines, KPIs, alerts, schedules, reports, documentation, and related offerings.
Customer Data means all data, telemetry, sensor readings, tracking data, location data, analytics, KPIs, alerts, schedules, and other information processed through the Services.
The Services provide cloud-based IoT monitoring, data ingestion, analytics, automation, tracking, and visualization tools. The Services are not designed or certified for life-critical use.
THE SERVICES MUST NOT BE USED IN ANY APPLICATION WHERE FAILURE COULD RESULT IN DEATH, PERSONAL INJURY, OR SERIOUS DAMAGE, INCLUDING MEDICAL DEVICES, LIFE SUPPORT, OR EMERGENCY SYSTEMS.
You are solely responsible for safeguarding credentials, API keys, access tokens, and connected devices. SensorTree disclaims all liability arising from customer security failures.
Outputs, alerts, and analytics are provided for informational purposes only and may be delayed, incomplete, or inaccurate.
You are responsible for verifying data accuracy and decisions made based on the Services. SensorTree assumes no liability for reliance on outputs.
SensorTree does not guarantee uninterrupted or secure operation and is not liable for outages, cyberattacks, or data breaches except as required by law.
AI and predictive features are probabilistic and provided without guarantees. Customer assumes all associated risk.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENSORTREE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You agree to indemnify and hold harmless SensorTree from claims arising out of misuse of the Services.
You agree to comply with applicable export control and sanctions laws.
SensorTree shall not be liable for delays caused by events beyond reasonable control.
These Terms are governed by the laws of the State of Georgia. Disputes shall be resolved by binding arbitration unless prohibited by law.
